In a shocking video, Carey Birmingham can be seen pointing a gun at a phone. Behind the camera was his wife Patricia Birmingham. “All right, goodbye. You’re going to meet Jesus,” he said before shooting her three times.
The December 2021 incident was allegedly a crime of sudden passion. Carey Birmingham, then 60, had just found out that his wife, 48-year-old Patricia, had been cheating on him. The two argued for about a half hour with tempers escalating.
The argument culminated with Carey shooting his wife in front of their Spring, TX home. Their teenage daughter Olivia was in school at the time.
“I hope it was worth it,” he said in the video, obtained by ABC 13. “I’m done, I’m f–king done.”
The Sentencing
On March 5, 2024, an all-female jury sentenced Birmingham. He had pleaded guilty to the crime, resulting in only a 10-year jail sentence. He was also fined $5,000 and will be eligible for parole in five years.
The public was shocked by the leniency of his sentence. Birmingham’s’ lawyers argued that the shooting was done “in the heat of the moment.”
Olivia stated that she found her father’s defense questionable at best. She didn’t believe the shooting was a crime of passion. “I don’t know, sudden passion? You have to have something. You have to have made that decision within you for a while; I feel like to do something, to do that to someone you really love,” Olivia said.
Patricia’s sister Mary Dees expressed that she believes justice was not served. She also stressed that Carey Birmingham was not the victim in this situation.

Earlier, Olivia commented on the crime saying, “I lost both my parents that day. My dad died that day too because the person who did that to my mom and my father are not the same.”
“You know what you did and how you took away my favorite person in this world.”
Olivia stated that she never saw her father physically abusing her mother, but she noted he abused her financially and emotionally. She wants to raise awareness that there are all types of abuse. She said she would never forgive him for her mother’s death.
